Privacy and cookie statement LIV Residential

This privacy and cookie statement was most recently amended on 24 April 2023.

As part of OCP Asset Management B.V., LIV Residential is the operator of the LIV Residential platform and the LIV Residential app. LIV Residential offers the LIV Residential platform, an online platform where house hunters are put in touch with providers of rental properties via the website www.livresidential.dk. In addition, LIV Residential offers the LIV Residential app. This is the mobile community application that enables tenants, to – among other things, though without limitation – communicate with each other, and submit repair requests with regard to the property to the landlord, which is made available by LIV Residential or its supplier(s). As we put house hunters in touch with providers of rental properties, and enable tenants to communicate with each other on a daily basis, we constantly process personal data. Your privacy is of great importance to LIV Residential. Therefore, we adhere to the General Data Processing Regulation (GDPR).

Our privacy and cookie statement in brief

In processing personal data, we comply with privacy legislation. This means that we:

  1. Lay down our purposes clearly in this privacy and cookie statement before processing your personal data.
  2. Store as little personal data as possible and only store those data that are required for our purposes.
  3. Ask explicit permission for the processing of your personal data, if permission is required.
  4. Take the required security measures to protect your personal data. These obligations are also imposed on parties that process personal data on our behalf.
  5. Respect your rights such as the right to inspection, rectification or deletion of your personal data that we have processed.

For which purposes do we use your personal data?

If you use the LIV Residential platform and the LIV Residential app, we obtain various personal data from you. For each purpose, we will indicate which data we obtain from you, for what purpose we process them and for how long they will be retained. If you have any questions, or would like to know exactly which data we store, please contact LIV Residential. The contact details are at the bottom of this privacy and cookie statement.

Creating and managing your account

We will process the following personal data:

  1. name
  2. address details (address, postal code and city)
  3. contact details (email address and telephone number).

We will retain your personal data for a maximum of two years after you last logged in to our website. In such case, we will assume that you no longer wish to make use of our services. We retain some data for longer if we are required to do so by law (e.g. in connection with the tax-related 7-year retention obligation).

Formation of a rental agreement

Our platform enables you to request to view a rental property (performance of the agreement). We will process this application as soon as possible. The viewing will be conducted by LIV Residential itself. In order to qualify for a LIV Residential rental property, you must meet the rental requirements. To prove this, we must perform an RKI credit check and World check. The formation and signature of a rental agreement takes place via the online application Esignature or Docusign.

To that end, we will process the following personal data:

  1. Personal identification details (name, date of birth, place of birth)
  2. Document number, identification document and/or passport
  3. Address details (address, postal code and city)
  4. Contact details (email address and telephone number)
  5. Financial details (employment, income, guarantors, IBAN/bank account number).

We keep your personal data for two years after the termination of the rental agreement. We retain some data for longer if we are required to do so by law (for example, because of the tax-related 7-year retention obligation).

Contact

When you send an email message, make use of our contact form, request a viewing, or contact us by telephone or otherwise, you are responding to our offer to enter into a contract with us (performance of the agreement).

As a result, we will process the following personal data:

  1. Personal identification details (name)
  2. Contact details (email address and telephone number)
  3. Financial details (income)
  4. Any information you enter yourself as the content of the message

We will retain your personal data for as long as is necessary for this contact or for up to one year after we last had contact with you, as we want to be sure that we have handled your question or complaint properly.

Commercial messaging

LIV Residential sends out commercial messages. This includes digital newsletters, as well as push messages or SMS messages. You can subscribe to our commercial messages via the website. When we approach you as an existing customer with offers concerning our own and similar products and/or services, we do so on the basis of legitimate interest. If you are not an existing customer, or the commercial communication does not concern our own and similar products and/or services, we will send it only with your consent.

As a result, we will process the following personal data:

  1. Personal identification details (name)
  2. Contact details (email address and telephone number)
  3. Financial details (income)
  4. Contact details (email address and telephone number)
  5. Financial details (employment, income, guarantors, IBAN/bank account number).

We will retain your personal data until you unsubscribe from commercial communications. You can unsubscribe from these messages at any time. Each newsletter contains an 'unsubscribe' link, but you can also adjust your settings in your account.

Statistics and analyses

Finally, we process your personal data for quality and market research to improve our services. We process your personal data on the basis of legitimate interest

As a result, we will process the following personal data:

  1. Sex
  2. Date of birth
  3. Financial details (ratio of income to rent)
  4. Search terms

We do not keep your personal data for longer than is necessary for this purpose

Background check

If you wish to become a customer, we will provide your personal data to various third parties/processors that are affiliated with LIV Residential. Within the framework of creditworthiness checks, for example, we use RKI-tjek, Scope-Check, and World-Check. These parties process personal data on LIV Residential's behalf and will use this data to provide an opinion on your creditworthiness. If you wish to object or obtain information about how these parties use your personal data, please see the above-mentioned privacy statements for more information. We currently provide the following personal data:

  1. First name
  2. Last name
  3. CPR number
  4. Current address (postcode and house number).

Creating a personal profile

We combine your personal data from different sources. We do this to provide you with the best possible service. We do this by linking different details about you, such as your account details, the details provided on the platform, and the preferences you indicate, as well as your browsing behaviour on our website.

By combining your data, we can publish personalised offers and personalised content on the website or social media channels that match your interests. In addition, it enables us to personalise our newsletter for you. This allows us to make more targeted offers, on our website but also through external advertisements.

We create profiles only with your consent. When collecting and combining your data, we use cookies on the website. Cookies allow us to – for example – see which pages on our website you have visited, which advertisements on external websites have been shown to you, and whether you have viewed them. Sharing personal data with third parties

LIV Residential will share your personal data with third parties only where this is permitted under the current legislation. We may provide your personal data to third parties because:

  1. We have engaged them to process certain data;
  2. This is required in performing the agreement with you
  3. You have provided permission to do so
  4. We have a legitimate interest in doing so
  5. We are legally obliged to do so (for example, if the police so demand in case of a suspicion of a crime)

The parties that process personal data on our or your behalf include:

  1. Payment service providers
  2. Viewing service providers
  3. IT suppliers and providers
  4. Marketing companies
  5. Review companies
  6. Property managers

When you use our platform and are interested in a property, we may share your personal data with the relevant estate agent at your request. The estate agent in question can subsequently contact you himself, for example to schedule a viewing. The estate agent is responsible for the personal data he processes for the purpose of his services. We bear no responsibility for this, and recommend that users take note of the relevant estate agent's privacy statement. You can usually find this information on the relevant estate agent's website.

In order to provide our services, LIV Residential may provide your personal data to parties located outside the European Economic Area (EEA). LIV Residential will do so only if the personal data are processed with an appropriate level of protection.

Protection of your personal data

LIV Residential has taken appropriate technical and organisational measures against loss or any form of unlawful processing (such as unauthorised inspection, impairment, alteration or provision of personal data) in connection with the processing of personal data to be performed.

Social media buttons

On our website, we use social media buttons, which bring you to the social media platforms. This gives you the option of following us and sharing content within the network. In addition, you will see advertisements on your social media page. The buttons work through pieces of code originating from social media networks. Cookies

  4. Right to deletion: you can ask us to delete your personal data.
  5. Right to withdraw your consent: if you have given us permission to process personal data, you can withdraw this consent at any time.
  6. Right to data portability: insofar as this is technically possible, you have the right to have your personal data that we process transferred to a third party.
  7. Right to restriction of processing: in some cases, you may ask us to restrict the processing of your personal data (whether or not temporarily).

In the event of such a request, we may ask that you provide identification. We do this to confirm that you are indeed the person to whom the personal data belong.

In principle, we will comply with your request within one month. However, this term may be extended by two months for reasons relating to the specific privacy rights or the complexity of the request. If we extend this term, we will inform you in good time.
